Digilatics, LLC, its parent companies, affiliates, and subsidiaries (collectively referred to as “The Company”, “we”, “our”, “us”) takes your privacy and data seriously. The purpose of this Privacy Policy is to describe how information is obtained when you utilize and we operate our websites, social media platforms, applications, ordering services, and any other services affiliated with The Company (collectively, “Services”). This Privacy Policy also describes and details how that information is used and protected.

This Privacy Policy does not describe or apply to the collection of or use of information on other websites such as those accessed through or linked to by our website (https://digilatics.com/). Notwithstanding the same, in the event that you continue to use our Services or otherwise access our website and other platforms, including those of any affiliates of ours, you agree by such use to abide by the terms of not only this Privacy Policy, but the Privacy Policy(ies), Data Policy(ies), and any other Terms of Use or written agreements of those affiliates pertaining to such use (the “Affiliates Policies”). If you do not agree with how your information is being collected, used, and protected, we respectfully request that you do not use our Services. Your access to and use of our Services constitutes your acknowledgement and acceptance of the terms of this Privacy Policy and any and all Affiliates Policies.

In no event will we sell or market your data or Information to marketers.

Protection and Retention of Information

We will make reasonable efforts to protect your Information as required by applicable state and federal laws. We will also retain your Information during your use and after you cease using our Services regardless of whether you delete or terminate any accounts involved therewith. We will retain your data in compliance with any retention obligations, limitations, or time frames imposed by state or federal law. If you would like your Information disposed of or destroyed after you cease using our Services, you may contact us as provided in Article VIII below. To the extent that we are legal required to do so, we will make best efforts to comply with your request. If we are not legally required to do so, we reserve any and all rights to decline your request.

If you have reason to believe that we are not properly protecting or retaining your Information, please contact us immediately and contemporaneously cease using our Services. We are not responsible for any further damage or harm suffered as a result of your continued use of our Services and/or failure to properly notify us after you have, or should have had, reason to believe that the protection or retention of your Information has been compromised. 

Children’s Online Privacy Protection Act (COPPA)

Per the Children’s Online Privacy Protection Act (“COPPA”), we do not knowingly or intentionally collect, use, or disclose Information from children under the age of thirteen (13) years without prior parental consent, except as otherwise permitted by COPPA or other applicable law. Our website and services are not directed to any children under the age of thirteen (13) years, and children under the age of thirteen (13) years should not use our website or services or provide Information about themselves without prior parental consent.

Revisions

We reserve the right to revise or modify this Privacy Policy at any time and for any reason. In the event that we do so, we will post the revised Privacy Policy on our websites and platforms so that it is easily accessible to yourself and others. You should review the policy periodically to ensure that there have been no revisions. Regardless of any notice or lack of notice, your continued use of our Services at all times constitutes and reaffirms your agreement to our prior and then-current Privacy Policy.

Without any requirement to do so, we may make attempts to provide notification of our Privacy Policy changes via email. If you have not provided or choose not to provide an email that may be used for such purposes, you understand and acknowledge that you may not receive notification of Privacy Policy changes. We will continue to use any Information collected in the manners authorized by the Privacy Policy in effect at the time that Information was collected. 

Jurisdiction-Specific Addenda

At all times, to the fullest extent permitted by applicable law, the terms, obligations, and other conditions in this Privacy Policy shall be construed pursuant to and under w the laws of the Commonwealth of Pennsylvania to the maximum extent permitted and regardless of your domicile or residence. Solely to the extent such applicable is expressly limited by applicable law, and with any and all conflicts of law construed in accordance with the Commonwealth of Pennsylvania, the following jurisdiction-specific addenda shall apply:

  • California Residents or Domiciled Entities. To the extent that the Company collects, uses, or processes Information of individuals or entities which are residents of or otherwise domiciled in, and subject to the laws of, the State of California, the requirements of the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights act of 2020 (“CCPA”), shall apply solely to such California residents and solely to the extent required by applicable law. Such individuals or entities understand that, during any preceding twelve (12) months, the Company may have collected such Information, as provided for in Section II or otherwise defined by the CCPA (e.g. identifiers, commercial information, internet or other electronic network activity information, geolocation data, professional and/or employment-related information, and inferences or observations drawn from any of the above). We may collect, use, sell, and/or share such information as more fully provided for in this Privacy Policy, except to the extent specifically limited by the CCPA. You understand that you have the following rights, without waiver of and subject to any applicable CCPA exceptions: (i) the right to request the disclosure of Information collected, used, disclosed, or otherwise shared (the “Right to Know”); (ii) the right to request the deletion and destruction of any and all Information, subject to the extent limited for purposes of any and all legal compliance by the Company (the “Right to Delete”); the right to request the correction or supplementation of any inaccurate information, provided that you provide such corrected or supplemented Information for use in the correction (the “Right to Correct”); the right to opt out of the sale or sharing of your Information by submitting requests to the contact information in Section IX below (the “Right to Opt-Out”); the right, to the extent commercially practicable, to limit the use of Information to permitted or otherwise authorized commercial or business purposes, and to the extent such limitation does not affect the Company’s ability to provide any Services to you (the “Right to Limit”) and the right to be free of any and all discriminatory treatment, solely limited to the extent defined in the CCPA, as a result of exercising any of these aforementioned rights. 

Notice of Breach

In the event that You become aware of, or reasonably suspect, any unauthorized disclosure of, access to, alteration of, or other compromise of your Information which is processed or otherwise maintained by the Company (a “Breach Incident”), You shall promptly notify the Company in writing of the same. Your notice shall include a reasonable description of such Breach Incident, the specific Information or categories of Information which You belief was the subject of such Breach Incident, and any and all other relevant and material information or details available to You. You are required to reasonably supplement such information about the Breach Incident as information becomes available to you and to reasonably cooperate with the Company in investigating, mitigating, and remedying any such Breach Incident. You shall not publicly disclose such Breach Incident to any third party without Company’s prior written consent, except to the extent expressly permitted by applicable law.
